By participating in this drawing, you are providing your signature, consent and agreement to receive marketing emails from the Global Medical Response, Inc, Sponsor of this promotion (“Sponsor”). Unsubscribe to end at any time. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The AirMedCare Network’s Refer A Friend Giveaway begins June 26, 2023 at 12:01 am Central Daylight Time (“CDT”) and ends August 15, 2023 at 11:59 pm CDT (“Drawing Period”).

Eligibility: Except as specifically excluded. open only to natural persons who are citizens or legal residents of the United States, physically residing in one of the 50 United States or the District of Columbia (excluding Alaska, Florida, New York, Rhode Island, Wyoming and West Virginia and wherever restricted or prohibited by law), and who are 18 years of age or older or have reached the age of majority in their state of residence as of the Drawing start date and who are members of the AirMedCare Network (“Entrant”). Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsor, affiliated companies, subsidiaries, retailers, distributors and advertising and promotion agencies, including Zeta Global, LLC, and their affiliates and each of their respective employees, shareholders, officers, directors, agents, members, successors and assigns, and any other entities directly associated with this drawing (collectively, “Released Parties”), are also not eligible to participate. All federal, state and local laws and regulations apply.

HOW TO ENTER: During the Drawing Period, eligible Entrants are automatically entered into the drawing when they provide a referral with a valid email address through the online referral form.

By Online Referral Form: During the Drawing Period, eligible Entrants may obtain Drawing entry by visiting the Sponsor’s website at https://www.airmedcarenetwork.com/refer-a-friend and following the instruction to complete and submit a referral form. A completed entry form with both a valid referrer and referee email address will generate ten (10) Drawing entries.

ODDS: Odds of winning depend on the number of eligible entries received during the Drawing Period.

Limits: Entrant may receive a maximum of ten (10) entries, using the online entry method described above. Proof of submission of an entry is not considered proof of delivery to or receipt by Sponsor. The Released Parties are not responsible for: (a) late, lost, incomplete, delayed, garbled, distorted, damaged, or misdirected entries; (b) causes beyond Released Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Drawing; (c) any entries submitted in a manner that is not expressly allowed under these Official Rules; (d) incorrect or inaccurate entry information; (e) any typographical or other error in the printing or advertising of this offer, in the administration or execution of the Drawing, or in the announcement/notification of the prize Winners; or (f) cheating or fraud by any participant. All incomplete or non-conforming entries will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned except as provided herein. By participating, you consent to Sponsor’s and its agents’ use of your personal information for the administration of this Drawing. By participating, you also consent to receiving emails from the Sponsor. Unsubscribe at any time.

Any attempt(s) made by the same individual to submit more than the permitted entries by using multiple emails, false contact information, accounts, or otherwise may result in the Entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified.  Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Drawing at Sponsor’s sole and absolute discretion. Entries submitted by an Entrant who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. All materials submitted become the physical property of Sponsor and will not be returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the registered account holder of the email address associated with the entry. Winners may be required to show proof of being the registered account holder. Registered account holder is defined as the person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules and/or other instructions of Sponsor may be disqualified.

DRAWING AND NOTIFICATION: One (1) random winner will be drawn on or about 8/22/2023 from among all eligible entries received during the Drawing Period in accordance with these Official Rules through the entry methods offered. The potential winner will be notified on or around 8/25/2023 using the email address provided in their entry. All drawings will be conducted by the Sponsor or Administrator whose decisions are final and binding in all matters relating to this Drawing. All potential winners are subject to verification by Sponsor or Administrator.  Winners will be notified by email and will be required to respond to the notification within three (3) business days indicating whether they will accept the prize. In the event that any email to the potential winner is returned as undeliverable, a response to any given email is not received within three (3) business days of date of its issuance, or the potential winner is not in compliance with these Official Rules, the prize may be forfeited and, at Sponsor’s discretion, one (1) alternate winner may be selected. Any alternate selected may also be required to respond to the notification within three (3) business days. The Released Parties are not responsible for suspended or discontinued internet or wireless service which may result in potential winner not receiving initial prize notification.

PRIZE(S): There will be one (1) prize (each a “Prize”) awarded in this Drawing.  Prize: a gift card for $200.

The Approximate Retail Value of all prizes combined is $200.00. All Prizes legitimately claimed will be awarded.

PRIZE CONDITIONS: By accepting any prize, the winner(s) agrees to release the Sponsor and the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. Prize Winner is solely responsible for any costs and expenses associated with acceptance and use of a Prize not specified herein as being awarded.

PUBLICITY GRANT: Subject to applicable law, winners irrevocably grant Sponsor and its parents, subsidiaries, related companies, and licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Drawing, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any compensation, obligation, notice or consideration except for the awarding of the Prize(s) to the winners.

LIMIT OF LIABILITY: IN NO EVENT WILL SPONSOR, ADMINISTRATOR, THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS DRAWING OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES.

1.        GENERAL CONDITIONS OF ENTRY: This Drawing is subject to all applicable federal, state, and local laws. By entering the Drawing, Entrant agrees to release, discharge, indemnify and hold harmless the Released Parties, and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Drawing or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrant further acknowledges that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. By participating, Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor and/or Administrator and waive any right to claim ambiguity in the Drawing or these Official Rules. Sponsor or Administrator reserves the right to disqualify any Entrant that it determines, in its sole discretion, violates these Official Rules. This Drawing is void in Alaska, Florida, New York, Rhode Island, West Virginia and Wyoming and where prohibited by these Official Rules or by law or where the Drawing does not comply with applicable registration or filing requirements of any state or local jurisdiction. Winners assume all liability for any injury or damage caused, or claimed to be caused by participation in this promotion or use or redemption of any prize.

All Entrants, as a condition of entry, agree that they have not been required to purchase any kind of Internet, wireless, or data service whatsoever in order to participate in and/or enter the Drawing. The Released Parties are not responsible for the actions of Entrants in connection with the Drawing, including Entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Drawing. Persons found tampering with or abusing any aspect of this Drawing, or who Sponsor believes to be causing malfunction, error, disruption or damage may be disqualified. Additionally, any attempt to cheat the Drawing, as determined in the sole and absolute discretion of Sponsor, may result in immediate disqualification of the Entrant, as well as other possible consequences, including disqualification from any and all existing and future drawings. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING ANY SOCIAL MEDIA PLATFORM OR APPLICATION) OR UNDERMINE THE LEGITIMATE OPERATION OF THIS DRAWING MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole and absolute discretion, to disqualify (or terminate the prize of) any individual who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in an unsportsmanlike, obscene, immoral, or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.

Entrant further understands and agrees that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release(s) are hereby expressly and forever waived. Entrant acknowledges that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

DISCLAIMERS: If for any reason this Drawing becomes compromised or is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which affect the administration, security, fairness, integrity or proper conduct of this Drawing, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, to change the Official Rules, to cancel, modify, suspend, or withdraw the Drawing or any Drawing offer and/or cancel, modify, suspend, or withdraw any method of entry, without notice, in whole or in part, at any time, and award the Prize(s) using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sponsor and Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any wireless telephone network, wireless signal coverage or telephone lines, computer systems, servers, providers, or computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error, or traffic congestion on the Internet, mobile service provider, or at any website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this Drawing or downloading any materials in this Drawing.

PRIVACY STATEMENT: All information submitted by Entrant will be treated according to Sponsor’s privacy policy, available at https://www.airmedcarenetwork.com/privacy. Where the Privacy Policy conflicts with these Official Rules, the Official Rules control. By participating in the Drawing and providing your email address, Entrant hereby agrees to Sponsor’s collection and usage of Entrant’s personal information, agrees to receive emails from the Sponsor (unsubscribe to end at any time), and acknowledges that Entrant has read and accepted Sponsor’s Privacy Policy.

GOVERNING LAW: The parties agree that the Drawing and these Official Rules will be governed, construed and interpreted under the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Texas.

DISPUTES: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action and exclusively by final and binding arbitration under the rules of the American Arbitration Association; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) the arbitration shall be conducted in the state of Texas and judgment on the arbitration award may be entered into any court having jurisdiction thereof. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Denton County, Texas.

BY ENTERING THE DRAWING, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE DRAWING, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules or the winner Affidavit will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the winner Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules or any other guidelines, instructions, policies, or term will not constitute a waiver of that provision. Entrant agrees to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect, in any manner, the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Drawing-related materials, privacy policy or terms of use on any website, social media platform or application, and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
